1.  Introduction

This correspondence is submitted in accordance with Iowa Code Chapter 22 to obtain public records and documentation relevant to allegations of statewide discrimination and ethical misconduct involving:

Erika Eckley, Executive Director, Iowa Public Information Board

Julie Pottorff, Former Member, Iowa Public Information Board

Kaitlin Smith, Regulatory Compliance & Administrative Process Manager, Iowa Civil Rights Commission

Evidence indicates that the Iowa Civil Rights Commission failed to act in accordance with Iowa Code §§ 216.5(1) and 216.5(3), which mandate prompt and impartial investigations of civil rights complaints, specifically regarding case CP#10-23-80682.

Two previous records requests were submitted to the State of Iowa Attorney General’s Office (attached) pursuant to Iowa Code § 22.4(2). Evidence supporting the failure of the State of Iowa Attorney General’s office to properly respond, pursuant to § 22.8(4)(d), now requires that all future situation reports, investigative updates, and records requests shall be directed to Attorney General Brenna Bird and each of her Deputy Attorneys General.

Any further evidence of:

  1. “means that have no substantial purpose other than to embarrass, delay, or burden a third person” (See Iowa Rules of the Court Chapter 32:4.4(a)).
  2. “conduct that is prejudicial to the administration of justice” (See Iowa Rules of the Court Chapter 32:8.4(d)). 
  3. “unlawfully obstruct another party’s access to evidence or unlawfully alter, destroy, or conceal a document or other material having potential evidentiary value…” (See Iowa Rules of the Court Chapter 32:3.4(a)).
  4. “…other unlawful discrimination in the practice of law or knowingly permit staff or agents subject to the lawyer’s direction and control to do so.”  (See Iowa Rules of the Court 32:8.4(g))

Will be immediately reported to the Iowa Supreme Court Attorney Disciplinary Review Board pursuant to Iowa Rules of the Court Chapters 32 and 35.

2.  Records Requested

The following public records are being requested in accordance with Iowa Code Chapter 22.

  1. A public record identifying the electronic mail address for Attorney General Brenna Bird.
  2. Microsoft 365 billing records for domain ag.iowa.gov, including the license count of all tax-funded Microsoft 365 users.
  3. A copy of any public records from the following accounts containing the terms “vexatious” or “Merritt”, or referencing or received from erika.eckley@iowa.gov:  cindy.glick@ag.iowa.govjessica.reynolds@ag.iowa.gov.
  4. All electronic mail received from or transmitted to erika.eckley@iowa.gov by end users within ag.iowa.gov.
  5. The Facebook Page Block List for the following publicly maintained page, per Iowa Code Chapter 22 and IPIB Case 22FC:0091:  🔗 https://www.facebook.com/AGIowa.
  6. Confirmation of whether Cindy Glick and Jessica Reynolds are licensed attorneys in the State of Iowa and the name of the licensed attorney to whom they report (or reported to at the time of the attached electronic mail) within the AG’s office.
  7. The name and title of the licensed attorney who manages the public records process within the Attorney General’s Office.

3.  Conclusion

If it is the intention of the State of Iowa Attorney General’s Office to criminalize me—as others have attempted before you (City of Newton, IA, Attorney Matthew Brick, Jasper County, IA, Attorney Scott Nicholson, Iowa Public Information Board Executive Director Erica Eckley, and Johannes H. Moorlach)—I will pray for you that your efforts are more competent and ethical than those of the unqualified who came before you.

The State of Iowa has already taken everything from me. I died in a VA hospital bed many years ago. What stands before you now is a veteran forged by loss, serving in defense of those who are unable to defend themselves.
